Amodality LLC ("we", "us", "our") provides this Privacy Policy to describe the collection, storage, use, and processing of your ("user", "you", "your") information.

"Services" refer to all of our websites, apps, products, etc.

"Content" refers to information and data you create, upload, or otherwise provide to us through your use of our Services. This includes, but is not limited to, messages, posts, videos, images, audio, documents, any other files or representations of data, etc.

By using our Services, you accept our Privacy Policy, and you agree to our collection, storing, processing, use, and disclosing of your information as outlined by this Privacy Policy.

3. Minimum Age

We do not knowingly collect information from anyone under 13 years of age without parental consent. If we find that an individual under 13 years of age provided their information to us without parental consent, we will delete the information we have collected from them.

4. How We Collect, Process, And Use Information

4.1. Automatic Collection

When you access our Services, we may automatically collect the following information:

We use this information to contact you, to personalize our communication with you, to fulfill your inquiries and requests, to provide you our Services, and to protect our Services from fraud, misuse, or abuse.

If you wish to communicate to us by text, you will first need to contact us by email for instructions. When using text to communicate with us, mobile messaging rates and data rates with your mobile carrier may apply. As part of the instructions we provide for texting us, we will include instructions on how to cease communication over text with us, which is a process you can initiate at any time.

We are not responsible for the privacy practices of any third-party service or platform. If you choose to contact us through a third-party service or platform, they may have their own privacy policies or statements. Please read their privacy policies or statements before using them.

By contacting us, you agree that we may respond to any communication we receive from you. Additionally, you agree to be mindful of the information you communicate to us.

4.3. Account Information

Some of our Services or features of our Services require an account with us. When you create an account, we may collect the following information:

  • Your email address.
  • Your company or employer.
  • Your password, access token, or any other authentication credentials, or any representations of any authentication credentials.
  • A unique user ID to be associated with you (generated on account creation).
  • Any Content and/or other information you provide to us for your account or user profile.
  • Any information provided to us from any social login services you use.
  • Any other information you provide to us during the account creation process.

With an account, you have the ability to access, change, and/or delete some of your information with us through our Services at any time. Additionally, we give you the ability to delete your account with us at any time.

4.4. Using Our Services

When using our Services, we may collect the following information:

  • Your Content.
  • Your settings and/or configurations of our Services.
  • Changes to your account information that you provide to us.
  • Timestamps of actions you make while using our Services.
  • Any errors resulting from you using our Services.
  • Any other information you provide to us during your use of our Services.
  • Client-side encrypted data for any of the above.
  • Client-side encrypted data for the encryption keys associated with your information.
  • Unencrypted encryption keys associated with any client-side encrypted Content you report to us.

The collection of this information is necessary in order to provide you the Services you request from us.

4.4.1. Client-Side Encryption

Our collection of client-side encrypted data is applicable when one of our Services, or a feature of one of our Services, utilizes client-side encryption. With client-side encryption, information is encrypted on your device before it is sent to us.

When we receive client-side encrypted data, we typically only receive encrypted data, and not any unencrypted information or unencrypted encryption keys.

An exception to this is when client-side encrypted Content is reported to us. When you report client-side encrypted Content to us, you submit the unencrypted encryption key associated with the Content, so we can decrypt the Content for review.

4.5. Payments And Other Transactions

When making transactions with us, such as payments for using our Services or features of our Services, we may collect the following information:

  • Your full name.
  • Your billing address.

We use third-party payment processors to handle your bank information, credit card information, or other information applicable for completing your transactions with us.

Our Privacy Policy only applies to our Services; it does not apply to third-party payment processors. We are not responsible for the privacy practices of third-party payment processors. They may collect your information they consider necessary in order to complete your transaction with us. Please review the privacy policies or statements of third-party payment processors before using them to make transactions with us.

The third-party payment processors we use are described in a later part of this Privacy Policy.

We may collect your payment information from the third-party payment processors involved in your transactions, which may include:

  • The last few digits of your credit cards or similar cards associated with your transactions, if applicable for the specific third-party payment processor used.
  • Your transaction history with us, such as previous invoices and receipts, previous payments, etc.

We collect this information for our own records, and to provide you the Services you pay for.

4.6. Email Notifications

When signing up for email notifications for our newsletters, account notifications, etc., we may collect the following information:

  • Your email address.

By signing up for email notifications, you agree to receive emails from us, including emails sent automatically.

4.6.1. Unsubscribing

You may unsubscribe from email notifications at any time. To unsubscribe from email notifications, automated non-essential emails will contain instructions for unsubscribing.

4.7. Other Sources

We may receive your information from other users of our Services, and/or from third parties and/or their platforms. Below are a few examples:

  • We may collect your information that is publicly available.
  • When another user reports to us Content you create or upload to our Services, we receive your Content and any other information included in the report from the reporting user.
  • When you use social login or similar single sign-on method to sign up and/or access your account with us, we may receive your information from the provider of the social login service or single sign-on method.
  • When you communicate with us through a third-party service or on a third-party platform, such as social media, web conferencing, email, etc., we may receive your information from the third party or their service/platform.
  • A third-party service or platform may disclose your information to us if permitted by their privacy practices or with your consent.
  • If any of our vendors have your information, they may disclose your information to us if permitted by their privacy practices or with your consent.

4.8. Cookies

We use Cookies and similar technologies for authenticating users with our Services, and to protect our Services from misuse and abuse.

The Cookies we use, including third-party cookies, are strictly necessary for our Services to function properly. If you do not consent to our use of cookies, please do not use our Services.

We use both Session Cookies and Persistent Cookies. Session Cookies expire after you close your web browser, while Persistent Cookies may not expire until a much later time, and will not expire from simply closing your web browser. To remove Persistent Cookies, please refer to your web browser's instructions for clearing Cookies.

4.8.1. Third-Party Cookies

We use Cookies from the following third parties for the following purposes:

  • Cloudflare - To protect our Services from misuse and abuse, and to remember your completion of verification challenges.

4.8.2. Local Storage And Session Storage

Web browser Local Storage and Session Storage work similar to Cookies, except Cookies are sent to us frequently over the internet, while Local Storage and Session Storage are not sent as frequently, if at all.

We may use Local Storage or Session Storage to save some of your website preferences, any non-cloud save data, and any other client-side data or information not meant to be frequently sent to us.

Information in Session Storage only persists until you close your web browser, while information in Local Storage will continue to exist even after you leave our website and close your web browser. To remove Local Storage, please refer to your web browser's instructions for clearing Local Storage.

4.9. Categories

The California Consumer Privacy Act defines categories of information, and requires us to list the categories of information we collect and process. Below are the categories that may be applicable:

  • Identifiers (name, alias, email address, IP address, etc.)
  • Customer Records (name, address, government ID details, payment details, credit/debit card numbers, etc.)
  • Protected Classifications (gender identity, gender expression, sexual orientation, age, etc.)
  • Commercial Information (payment and purchase history, etc.)
  • Internet Or Electronic Network Activity (timestamps of actions and activity, etc.)
  • Geolocation
  • Audio, Electronic, Visual, Or Similar Information (audio, images, video, or other information potentially associated with a real individual, etc.)
  • Professional Or Employment-Related (job title, employer, etc.)

The specific information described in-line with each category are examples to help you understand the categories. Please refer to the other sections of this Privacy Policy for further explanation of the collection and processing of your information.

4.10. With Your Consent

We may collect and process information from you not described in this Privacy Policy. We will provide notice when applicable, and will only proceed with the collection and processing of your information with your consent.

5. Disclosing Information

In general, we only disclose information with third parties as necessary to our business operation, to comply with the law, and to provide you our Services.

5.1. Services You Request

It is possible to interact with other users with our Services. When using features that allow you to transmit your Content and information, or otherwise interact with other users, you give us permission to transmit your Content and information to make it accessible to other users.

5.2. Vendors And Service Providers

  • If we believe in good faith that it is necessary for assisting in preventing serious harm or death of any person.

We may disclose your information with our related companies, which includes our parent companies, our affiliates, our subsidiaries, etc.

Additionally, if there is a potential acquisition, reorganization, bankruptcy, or sale, transfer, or change of our ownership or assets, we may disclose your information.

5.5. Anonymous Or Aggregated Information

To publicly provide statistics on our Services, we may disclose anonymous and/or aggregated information to the public. When disclosing such information, we redact parts of the information to prevent any reasonable identification of any individuals.

5.6. With Your Consent

We may disclose your information in ways not described in this Privacy Policy. In such situations, we will provide notice, and will only proceed with disclosure of your information with your consent.

We primarily store and process information in the United States, as we are based in the United States.

To operate globally, we may store information in or transmit information to other countries where we, or our vendors and service providers, operate. By using our Services, you understand that your information will be stored, processed, and transmitted in the United States and in other countries.

7. Data Security

We encrypt information at rest, and we use Transport Layer Security to encrypt information in transit to and from us. We control access to information by limiting access to only select authorized individuals.

Some, but not all, of our Services additionally use client-side encryption.

Absolute security in electronic transmissions or encryption systems does not exist. We take measures to prevent unauthorized access, transmission, alteration, or destruction of information, but we cannot make any guarantees. By using our Services, you agree that you acknowledge these risks.

8. Data Retention

We keep your information for as long as we need it to provide you our Services. We delete information when we no longer need it.

We may retain information in order to protect our Services. For example, we may keep information to help us identify users who have abused or misused our Services, or who have violated any agreements with us.

8.1. Inactivity And "Old" Data

For certain Services, we may delete your account if there is at least 180 consecutive days of inactivity. Inactivity is measured from when you last accessed your account. If your account has associated contact information, we will attempt to contact you before account deletion.

Additionally, we may delete "old" information and Content linked to your account regardless of activity or inactivity on your account. We will inform you of this process where applicable, and we will specify the criteria for "old" information when applicable, as the criteria varies across our Services.

If you pay for our Services, the inactive account deletion policy will not apply as long as you continue payment. Additionally, any criteria for "old" information and Content for deleting may become relaxed, adjustable by you, or not applicable.

9. Legal Basis

In general, we collect, process, use, and disclose your information where at least one of the following circumstances apply:

  • With your consent.
  • When necessary for providing you our Services or fulfilling agreements between us.
  • Where we are legally obligated to.
  • Where we have any legitimate interests.
  • Where vital interests apply.

The rights granted by various privacy regulations, subject to certain restrictions, include the following:

  • The right to delete your information from our Services and systems.
    • In some cases, and with certain information, we are obligated to retain information for our legitimate interests to protect us and our Services, as previously described.

    • To our understanding, we do not "sell" your information as defined by the California Consumer Privacy Act.
  • The right to know about any financial incentives we offer to you for our collection and processing of your information.
    • We do not offer such financial incentives.
  • The right to limit our use and disclosure of your sensitive information, where sensitive information refers to any information revealing an individual's government ID, finances, geolocation, ethnicity, religion, sexual orientation, union, membership, private communications, genetics, biometrics, health, etc.
  • The right to withdraw your consent to our collection and processing of your information.
    • The lawfulness of our collection and processing of your information that occurred prior to your withdrawal of consent will not be effected.
  • The right to not be discriminated against for exercising your privacy rights.

10.1. Exercising Your Rights

We provide ways to exercise your privacy rights through features of our Services, and by allowing you to make privacy requests to us.

While we will try our best to fulfill your privacy requests, regardless of the jurisdiction you may reside or are located, we cannot guarantee the successful fulfillment of your request if you do not reside in a jurisdiction where privacy regulations apply.

When you make requests to exercise your rights, we may request additional information from you to verify your identity.

You may appoint an agent to exercise your privacy rights on your behalf. If you appoint an agent, we will need to verify their relationship with you.

11. Other Third Parties Disclaimer

As already described, you may encounter third-party services as a result of using our Services. Third parties not yet described in this Privacy Policy include the following:

  • Third-party app stores where we make our Services available for download.
  • Third-party websites made available through links in our Services.
